In the past, text messages, emails, browsing history, and recorded calls were among the main forms of digital evidence. Now AI chat logs are joining that list. To the user, an AI conversation may feel like a private note typed out alone at a computer. But an opposing party or an investigator may see it very differently. This case drew attention for a deeper reason than simply “AI can become evidence.” People are increasingly using AI as if it were a real adviser. But the court looked at AI not as an adviser, but as a platform or service tool. That difference matters a great deal. A user may experience the exchange as confidential support, while a court may see it as an unprotected external record.

What makes this area especially important is that U.S. courts are not moving in one perfectly uniform direction. In a Michigan case, for example, a self-represented litigant used ChatGPT while preparing for litigation, and the court did not treat those exchanges as material that automatically had to be turned over to the opposing side.

The character of the conversation, the purpose behind it, the scope of sharing, and the structure of the platform all matter.
Courts are often asking the same basic question. Was this a protected confidential exchange, or was it a dispute-related record created through an outside platform? In that sense, the exact words in the AI chat may matter less than the context in which the tool was used.

This issue is not limited to people who expect to end up in court. If an employee pastes internal issues into an AI system, asks about a potentially contentious transaction, or summarizes sensitive contract terms using generative AI, the same questions can arise later in discovery, investigation, or litigation. The spread of generative AI does not only increase productivity. It also raises legal, compliance, cybersecurity, and digital forensics concerns. In the years ahead, the ability to use AI effectively may matter, but the ability to avoid using it recklessly may matter just as much.
